1. Agreement to Terms
These Terms of Use ("Terms") are a binding agreement between you and Nutrivine ("we," "us," or "our"). They govern your access to and use of the Nutrivine mobile application, website, and related services (collectively, the "Service").
By creating an account or using the Service you accept these Terms in full. If you do not agree, you may not use the Service.
2. Description of Service
Nutrivine is an AI-powered nutrition tracking application that enables users to:
- Log food via AI photo recognition, barcode scanning, voice input, or manual search across a database of 4 million+ foods
- Track calories, macronutrients, and 60+ micronutrients with science-based DRI targets personalized to age, sex, and life stage
- Monitor weight, activity, water intake, caffeine, and long-term nutrition trends
- Receive AI-generated nutrition insights and ingredient analyses
- Connect third-party fitness services such as Strava
- Participate in a community by rating and commenting on products
3. Eligibility & Account Registration
You must be at least 13 years old (or 16 in jurisdictions with a higher age of digital consent) to use the Service. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.
When you create an account you agree to:
- Provide accurate and current information
- Keep your credentials confidential
- Accept responsibility for all activity under your account
- Notify us immediately of any unauthorized access
You may sign up with email and password, or via Google or Apple single sign-on.
4. Health & Medical Disclaimer
Important Notice
Nutrivine is an informational tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment.
Consult a professional. Always seek the guidance of a qualified healthcare provider before making dietary, exercise, or medical decisions, especially if you are pregnant, nursing, managing a chronic condition, or taking medication.
Accuracy of nutritional data. Nutrition information is sourced from USDA FoodData Central, Open Food Facts, and AI analysis. While we strive for accuracy, values may be incomplete or approximate. AI-generated estimates (photo scans, voice logs) should be treated as helpful approximations, not precise measurements.
Individual variation. DRI targets, calorie estimates, and macro ranges are population-level guidelines. Your actual needs may differ based on genetics, health status, and other factors your doctor can help evaluate.
Emergencies. In a medical emergency, contact your local emergency services immediately. Do not rely on the Service for urgent health guidance.
5. Subscriptions, Payments & Credits
Free Tier
The free tier includes unlimited food logging via search and barcode scanning, basic macro tracking, and a daily allowance of AI scan credits. Free users may see banner advertisements.
Premium Subscription
Premium unlocks unlimited AI scans, 60+ micronutrient tracking, advanced analytics, third-party integrations, and an ad-free experience. Premium is offered as a monthly or annual auto-renewing subscription.
Billing & Cancellation
- Subscriptions are billed in advance through the Apple App Store or Google Play Store
- Your subscription automatically renews unless you cancel at least 24 hours before the end of the current period
- You can manage or cancel your subscription in your device's store settings at any time
- Cancellation takes effect at the end of the current billing period. You retain premium access until then
- Refunds are handled by Apple or Google in accordance with their respective refund policies
- We may change pricing with at least 30 days' advance notice
AI Scan Credits (Free Tier)
Free users receive a daily allowance of credits for AI features (meal photo scanning, voice logging). Additional credits may be earned by watching optional advertisements. Credits reset daily and do not roll over.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Share your account credentials or allow others to use your account
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with, disrupt, or overload the Service or its infrastructure
- Upload malicious code, viruses, or harmful content
- Reverse-engineer, decompile, or disassemble any part of the Service
- Use bots, scrapers, or automated tools to access the Service without permission
- Post abusive, misleading, or spam content in product comments
We reserve the right to suspend or terminate accounts that violate these rules.
7. User Content
"User Content" means any data you create through the Service, including food logs, photos, voice recordings, custom foods, and product comments.
- You own your data. We do not claim ownership of your User Content.
- Limited license. By using the Service you grant us a non-exclusive, worldwide license to store, process, and display your User Content solely to provide and improve the Service.
- Community content. Product comments and ratings are visible to other users. Do not post content you wish to keep private in public community features.
- Aggregated data. We may use anonymized, aggregated data (which cannot identify you) for research, analytics, and product improvement.
8. AI Features & Third-Party Data
AI accuracy. Our AI features (meal scanning, voice logging, barcode analysis, nutrition insights) use machine-learning models that may produce errors. AI-generated nutrition estimates are approximations, not laboratory-grade measurements. You should verify critical nutrition information independently.
Food database. Nutrition data is sourced from USDA, Open Food Facts, and community contributions. While we work to keep data accurate and current, we cannot guarantee the completeness or correctness of every entry.
Third-party integrations. When you connect services like Strava, your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party service availability, accuracy, or conduct.
9. Intellectual Property
The Service, including its design, code, AI models, food database, branding, and documentation, is owned by Nutrivine and protected by copyright, trademark, and other intellectual-property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written consent.
The Nutrivine name, logo, and related marks are trademarks of Nutrivine. All rights not expressly granted are reserved.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By agreeing to these Terms you also acknowledge the practices described in the Privacy Policy.
11. Disclaimers & Limitation of Liability
"As Is" Basis
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by applicable law, Nutrivine and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Service.
Service Availability
We strive for high availability but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.
12. Account Termination
By you: You may request deletion of your account at any time from Settings > Account > Delete Account. A 14-day grace period applies, during which you can cancel the deletion. After the grace period, your personal data, uploaded media, and all associated records are permanently and irreversibly removed (see our Privacy Policy for details). Active subscriptions must be canceled separately through your device's app store.
By us: We may suspend or terminate your access if you violate these Terms, engage in abusive behavior, or if required by law. Where possible, we will provide notice before termination.
13. Changes to These Terms
We may revise these Terms from time to time. For material changes we will provide at least 30 days' notice via in-app notification or email before the new terms take effect. Continued use of the Service after the effective date constitutes acceptance. If you do not agree with the revised Terms, you should stop using the Service and delete your account.
14. Governing Law & Disputes
These Terms are governed by the laws of the United States without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the courts of competent jurisdiction. Nothing in these Terms limits any consumer-protection rights that apply to you under mandatory local law.
